Nollywood actor files suit to save marriage
Nollywood actor, Emeka Ike, yesterday, told a Customary Court in Lagos Island that he has filed an application before a Lagos High Court seeking to stop the lower court from further hearing a divorce suit filed against him by his estranged wife, Emma Suzanne Ike.
Suzanne had in 2015 filed an application in the Customary Court to separate the 16 years union between her and her husband, Emeka on alleged incessant battery.Ike had earlier denied the allegation and begged the court not to separate them, saying that he was still in love with his wife.
But when the matter slated for judgment yesterday was called, counsel to the actor, Mr. A. Labi-Lawal, informed the court that his client has filed a stay of proceedings application before the High Court of Lagos State.
The application, marked FCMP/20054/16, which has Emma Ike, the Customary Court’s President, Chief Amos Awosola as the first and second defendants, is seeking High Court’s declaration that the Customary Court of Lagos state lack requisite jurisdiction to entertain and determine the divorce suit, as the marriage between the estranged couple was conducted in Enugu State, under Igbo customs and traditions.
Ike is also urging the High Court to declare that all the proceedings already conducted by the Customary Court of Lagos State in respect to the couple’s marriage are null and void.
However, her lawyer, Mr. Iheanyi Awa, urged the court to discountenance the stay of proceedings application, and go ahead to deliver the judgment, adding that Emeka’s application was aimed at arresting the court’s judgment.
At the end of their submission, the three-man panel ruled that: “In view of the submission of the respondent, the stay of proceedings is hereby granted, and the matter is hereby adjourned sine die”.
